1. Overview
The Chuhching Affiliate Program ("Program") lets you earn recurring commissions by referring new paying customers to the Chuhching platform using your unique referral link ("/r/<code>"). By participating in the Program, you agree to these Affiliate Program Terms ("Affiliate Terms"), which supplement our Terms of Service.
2. Eligibility
- You must have an active Chuhching account in good standing.
- Self-referrals are prohibited. You may not use your own referral link to create an account for yourself or for any entity you control.
- We reserve the right to approve or deny any affiliate application at our discretion.
3. Commission
- Rate. You earn 40% of the referred customer's recurring subscription fee for the first 12 months of that customer's subscription. After the 12-month commission window ends, no further commissions accrue for that customer. Chuhching reserves the right to adjust the commission rate with 30 days' notice; changes apply to referrals made after the effective date.
- Attribution. A referral is attributed to you when a new customer signs up through your referral link and the "chuh_ref" cookie (60-day window) is present at the time of account creation. Commissions apply to new customers only; existing accounts and reactivations do not qualify.
- Cookie window. Attribution is last-click: the referral cookie lasts up to 60 days from the most recent click, and the most recently clicked affiliate link earns the referral. If the user clears cookies or uses a different browser, attribution may be lost.
4. Payout
- Commissions accrue as "pending" and become eligible for payout after a holding period to account for refunds and chargebacks.
- Payouts are processed monthly. Minimum payout threshold: $50. Balances below $50 roll over to the next month.
- Payment methods and tax documentation requirements will be communicated when you join the Program.
- You are responsible for all taxes owed on commission income. Chuhching may issue tax forms (e.g. 1099) as required by law.
5. Clawback and adjustments
If a referred customer receives a refund, initiates a chargeback, or cancels within the first billing cycle, the corresponding commission will be clawed back from your pending balance. We may also reverse commissions for accounts that were created fraudulently or in violation of these Affiliate Terms.
6. Promotional rules
- You may not use Chuhching's name, logo, or trademarks in any way that implies endorsement, partnership, or official affiliation without our prior written permission.
- You must comply with FTC disclosure requirements (16 CFR Part 255). Any blog post, social media post, video, or other content that includes your referral link must include a clear and conspicuous disclosure that you earn a commission on referrals.
- You may not run paid ads that bid on "Chuhching" or "PitchIQ" brand keywords without prior written approval.
- You may not make false, misleading, or unsubstantiated claims about the Service.
7. Fraud
Fraudulent activity — including fake signups, cookie stuffing, self-referrals, incentivised signups where the incentive is the primary reason for creating an account, or any manipulation of the referral system — will result in immediate termination from the Program and forfeiture of all unpaid commissions. Chuhching reserves the right to pursue legal remedies for fraud.
8. Termination
Either party may terminate participation in the Program with 30 days' written notice. Chuhching may terminate your participation immediately for fraud or violation of these Affiliate Terms. Upon termination, pending commissions that have cleared the holding period will be paid out; unvested commissions are forfeited.
9. Relationship of the parties
You are an independent contractor, not an employee, partner, or agent of Chuhching LLC. Nothing in these Affiliate Terms creates an employment, agency, or joint-venture relationship.
10. Governing law and disputes
These Affiliate Terms are governed by the laws of the Commonwealth of Virginia. Disputes are subject to the same binding arbitration and class-action waiver provisions set out in Section 16 of the Terms of Service.
